Earlier, the bail petition of petitioner was rejected, vide order dated 28.04.2022 passed in Cr.Misc. No. 1032 of 2021 (Annexure-1 to the petition).

The trial court report, kept at flag 'A', indicates that charge has already been framed on 07.02.2022 and now, the case is pending for prosecution evidence, for which, summons and bailable warrant of arrest has already been issued. Petitioner is in custody since 29.09.2021.

Considering the period of custody and the fact that till date not a single witness has been produced by the prosecution for evidence, the prayer for bail of petitioner is allowed.
