JUSTICE SANJAY PRIYA ORAL ORDER 20-11-2018 Heard the learned counsel for the petitioners, the informant and the learned A.P.P. for the State. The petitioners seek bail in Raj Nagar P.S. Case No. 189/2018, instituted for the offences under Sections 147, 148, 149, 341, 323, 324, 307, 325, 448 and 379 of the Indian Penal Code.

Learned counsel for the petitioners has submitted that there is case and counter case between the parties. Co-accused Shrawan Kumar Ram has filed Raj Nagar P.S. Case No. 190/2018 against informant and others. In the instant case, there is allegation that these petitioners along with F.I.R. named accused persons armed with deadly weapons arrived and assaulted the informant and other family members. Petitioners are alleged to

Patna High Court Cr.Misc. No.63206 of 2018(3) dt.20-11-2018 2/2 have assaulted the informant and his son Dhiraj Jha. Injury report of informant and his son is available in case diary, which shows that both injured have sustained simple injuries caused by hard and blunt substance.

Petitioners are in custody since17.08.2018.

Considering the aforesaid facts and circumstances, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st, Madhubani in connection with Raj Nagar P.S. Case No. 189/2018, subject to the conditions that both the bailors shall be close relative of the petitioners.
