Heard the learned counsel for the petitioners and the learned A.P.P. for the State.
The petitioners seek bail in Pratapganj P.S. Case No. 59/2018, instituted under Sections 302/34 of the Indian Penal Code.
Learned counsel for the petitioners has submitted that specific allegation has been levelled in the Fardbeyan against co-accused Shyam Das of pressing the neck of husband of informant, on account of which he died on the spot. It is mentioned in supplementary affidavit that Shyam
Patna High Court Cr.Misc. No.64610 of 2018(3) dt.28-11-2018 2/2 Das was step-son of husband of informant and there was dispute with regard to family property. These petitioners in no manner are beneficiaries of the alleged property. They are not directly related to the husband of informant. There is general and omnibus allegation against these petitioners. Petitioners are in custody since 19.05.2018.
Considering the aforesaid facts and circumstances, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Birpur, Supaul in connection with Pratapganj P.S. Case No. 59/2018, subject to the conditions that both the bailors shall be the close relative of the petitioners.
