Petitioner apprehends arrest in case registered for the offences punishable under Section 365 of the Indian Penal Code to which Sections 328, 323/34 of the Indian Penal Code were added later on.
It is alleged that some unknown miscreants kidnapped the son of the informant who somehow managed to escape from their custody. During course of investigation, son of the informant has specifically stated that this petitioner along with other persons had kidnapped him.
Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case only on the basis of suspicion. He next submits

No.74233 of 2022(4) dt.28-03-2023 2/2 that petitioner is not the person whose name has been stated by the victim because he has stated father's name of the petitioner as Suresh Verma whereas, father of the petitioner is Late Suresh Prasad. Parentage of the petitioner has been wrongly described in the statement of the victim recorded under Section 161 of Cr.P.C.
Learned counsel for the State opposes the prayer for bail application.
Considering the statement of the victim wherein he has specifically stated that this petitioner along with others kidnapped him, prayer for bail of the petitioner is refused. (Prabhat Kumar Singh, J) Navya/- U T
