The petitioner seeks bail in Darbhanga Mahila P.S. Case No. 48/2018, instituted under Sections 376, 366 and 323/34 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that the instant case has been filed by the informant only to put pressure upon the petitioner for performing marriage with her. It is further submitted that earlier mother of informant had lodged case in Arunachal Pradesh bearing Naharlagun P.S. Case No. 99/2018 levelling allegation that her daughter (informant) had some relationship with this petitioner, who had obtained some naked photographs of her daughter and was making the same public. The instant case has been filed by the informant

Patna High Court Cr.Misc. No.64615 of 2018(3) dt.22-11-2018 2/2 (Victim girl) levelling allegation that she was taken by this petitioner along with other accused persons to Himachal Pradesh about six months back, where she was confined in a room for three days. This petitioner is alleged to have established physical relationship with the informant on the pretext of marriage, but he did not marry with the informant. From the written report itself, it appears that petitioner and informant are known to each other and it is a matter of love affairs.

Petitioner is in custody since 16.06.2018.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Darbhanga in connection with Darbhanga Mahila P.S. Case No. 48/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
