JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-11-2018 Petitioner prays for bail in connection with Chhatapur P.S..Case No. 439 of 2017 registered for the offence punishable under Section 392 of the Indian Penal Code.

Allegation as per FIR is that while informant was returning on his motorcycle three miscreants intercepted him and snatched away his motorcycle and mobile and fled away. Petitioner is not named in the FIR and later on his name transpired as one mobile was recovered.

Submission of learned counsel for the petitioner is that impugned order itself shows that mobile has been recovered from his wife and she disclosed the name of the petitioner and except that there is nothing against the petitioner and after arrest he has been remanded in two other cases and petitioner is in custody for more than six and a half months.

Having heard both sides and in the facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-IV, Supaul, in connection with Chhatapur P.S.Case No. 439 of 2017, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
