JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-12-2018 Petitioner prays for bail in connection with Mahila P.S.Case No. 49 of 2018 registered for the offences punishable under Sections 341, 506 and 376 of the Indian Penal Code. Allegation against the petitioner is of forcibly committing rape upon the informant.
Submission of learned counsel for the petitioner is that medical report does not support the prosecution story and prosecutrix is a married lady and petitioner is in custody since 17.5.2018.
Heard learned APP also, who has opposed the prayer for bail stating that after committing rape petitioner was fleeing away and he was arrested and assaulted also, which will appear from the case diary.
Having heard both sides and in the facts and
Patna High Court Cr.Misc. No.65958 of 2018(3) dt.06-12-2018 2/2 circumstances, I am not inclined to grant bail to the petitioner. This application is, accordingly, dismissed.
