JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 2 12-12-2017 Heard learned counsel for the petitioners, learned counsel for the State and learned counsel for the informant. The petitioners seek pre-arrest bail in connection with Madhubani Mahila P.S. Case No. 52 of 2017 registered under Sections 341, 323, 354B and 379 of the Indian Penal Code.
It is submitted by the learned counsel for the petitioners that save and except Section 379 and 354-B of the
Patna High Court Cr.Misc. No.58695 of 2017 (2) dt.12-12-2017 Indian Penal Code, all other sections are bailable in nature. He submitted that the petitioners being ladies, the ingredients of the offence punishable under Section 354-B of the Indian Penal Code would not be attracted against them.
Learned counsel for the informant has vehemently opposed the application for grant of pre-arrest bail to the petitioners.
Considering the facts and circumstances of the case as also the nature of accusation made against the petitioners, in the event of arrest or surrender in the court below within six weeks from today, they are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Madhubani in connection with Madhubani Mahila P.S. Case No. 52 of 2017 subject to the conditions as laid down under Section 438(2) Cr. P.C.
