Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 31.7.2017 passed in Cr. Misc. No.34073 of 2017 with direction to the learned court below that once Cr. Writ is disposed of by the Court, on application for bail filed by the petitioner, he will dispose of the same considering the direction of this Court.
Submission of the learned counsel for the petitioner is that since the girl has been recovered and she has married with the petitioner, in support of the marriage he has shown Annexure 4, which is a certificate issued by the Marriage Officer. The petitioner is in custody for 10 months.
Heard learned A.P.P. and the learned counsel for the
Patna High Court Cr.Misc. No.59693 of 2017 (4) dt.07-02-2018 2/2 informant. They have opposed the prayer for bail stating hat the girl in her statement recorded under Section 164 Cr.P.C. has named this petitioner and also made allegation against him. Having heard both sides and in such view of the matter, I am not inclined to grant bail to the petitioner, as such the prayer for bail of the petitioner is rejected and as the petitioner is in custody for about ten months, the learned trial court is directed to expedite the trial within a period of one year from the date of order.
With the aforesaid observation, this application is dismissed.
