The petitioner, who is in custody, seeks bail in connection with Belher Town P.S. Case No. 27 of 1990 (S.T. No. 20/2018/T.R. No. 875/2018) registered for the offences punishable under Sections 307, 324 and 452 of Indian Penal Code and under Section 27 of the Arms Act.

The petitioner was granted bail in this case on 10.07.1990, but his bail bond was cancelled because of his non appearance on 01.06.2012. Thereafter, petitioner was declared absconder and non-bailable warrant was issued on 31.08.2017 thereafter Petitioner was arrested and produced on 23.06.2018. It has been submitted on behalf of the petitioner that he will not misuse the privilege of bail any further. It is further

Patna High Court Cr.Misc. No.68036 of 2018(3) dt.29-11-2018 2/2 submitted that the petitioner is an old man aged about 70 years and he was told that he will get notice after cognizance and only thereafter he will have to appear in the court. The petitioner is in custody since 23.06.2018 and as such he may be granted regular bail.

Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned District and Sessions Judge, Banka in connection with Belher P.S. Case No. 27 of 1990 (S.T. No. 220/2018/T.R No. 875/2018) with condition that petitioner shall co-operate in the trial and shall be present on each and every date fixed by the court and his absence on two consecutive dates without proper and sufficient reason, trial court will be at liberty to cancel his bail bond.
