The petitioner seeks bail in Dighalbank P.S. Case No. 50/2018, instituted for offences under Sections 302/34 of the Indian Penal Code.

Petitioner is husband of the deceased.

It is alleged in the written report that on 05.06.2018, the informant received information that his sister has died. The informant went to the house of his sister where he found dead body of his sister lying on verandah. There was mark of black spot around her neck on account of throttling. The informant suspected that petitioner has killed his sister and fled away from the house. It is further alleged that deceased was married with

Patna High Court Cr.Misc. No.66083 of 2018(3) dt.28-11-2018 2/2 this petitioner just two years prior to the occurrence. She was tortured in her Sasural for non-fulfillment of demand of dowry. Post-mortem report is available in case diary, wherein cause of death is opined due to asphyxia and shock as a result of throttling.

Therefore, this Court is not inclined to grant bail to the petitioner at this stage. Accordingly, prayer for bail of petitioner is rejected.

The trial court is directed to expedite the trial and make all efforts to dispose off the case as early as possible. (Sanjay Priya, J.) rakhi U T
