Petitioner seeks bail in P.R. Nadi P.S. Case No. 93 of 2018 (Special Case No. 7226 of 2018 Excise) registered for the offence punishable under Section under Section 30(A) of the Bihar Prohibition and Excise Act, 2016.
Informant who is the Sub Inspector of Police has stated in his written report that on receiving secret information a raid was conducted and a truck which was standing near the river illegal liquor of 2217 Litres was seized by the police and the persons present there on seeing the police fled away. It has been submitted on behalf of petitioner that the name of petitioner has come in this case on the basis of confession made by person who was apprehended at the place of occurrence. Petitioner is in custody since 05.08.2018.
Patna High Court Cr.Misc. No.67820 of 2018(3) dt.27-11-2018 2/2 Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Special Court (Excise), Patna, in connection with P.R. Nadi P.S. Case No. 93 of 2018 (Special Case No. 7226 of 2018 Excise), with following conditions:- (1)Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.
(2) Petitioner shall co-operate in the trial and shall be represented on each and every date fixed by the court.
(3) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.
