The petitioner seeks regular bail in connection with Parasi P.S. Case No. 102 of 2022 registered for the offence punishable under Sections 379 and 414 of I.P.C. As per the prosecution case, the petitioner was apprehended with stolen motorcycle.
Learned counsel for the petitioner submits that the petitioner had purchased the motorcycle from one Jitendra Kumar who had purchased the same from Udit Kumar against whom the allegation is that he had stolen the recovered motorcycle of one Surendra Kumar.
Petitioner is in jail custody since 18.09.2022 and he has no criminal antecedent. Charge-sheet has already been filed.
Patna High Court CR. MISC. No.73108 of 2022(2) dt.29-04-2023 2/2 Udit Kumar has already been granted bail from the Co-ordinate Bench vide order dated 27.02.2023 in Criminal Miscellaneous Case No. 67410 of 2022.
Learned APP for the State has opposed the prayer for regular bail of the petitioner.
Considering the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned in connection with Parasi P.S. Case No. 102 of 2022.
