The petitioners seek pre-arrest bail in connection with Garkha P. S. Case No. 376 of 2017 registered under Sections 341, 323, 307, 504 and 506/34 of the Indian Penal Code. It is submitted by the learned counsel for the petitioners that except the allegation that the petitioners were also present at the place of occurrence armed with gun and lathi, there is no other material to connect the petitioners with the alleged offences. He submitted that the specific allegation of overtact is against co-accused Manohar Singh. Despite repeated calls, Sri Ramchandra Sahani,

Patna High Court Cr.Misc. No.58386 of 2017 (2) dt.12-12-2017 2/2 learned Additional Public Prosecutor, who is interested with the brief, has not appeared to contest the matter. Considering the submissions made by the learned counsel for the petitioners, which is not opposed by the counsel for the State, the petitioners named above are directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in Garkha P. S. Case No. 376 of 2017, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure, in the event of arrest or surrender before the court below within six weeks from today.
