1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. This application, for grant of anticipatory bail, arises out of Bikramganj Police Station Case No. 227 of 2024, dated 21.04.2024, disclosing offences under Sections 21.04.2024 of the Indian Penal Code.

3. The prosecution case, as per the First Information Report, is that on 20.04.2024, while younger brother of the informant was returning home after filling online form and was standing near Brahm Baba, he was fired upon by the petitioner, along with other co-accused persons, on his right hand and chest due to which he sustained fire-arm injury and, thereafter, he was taken

Patna High Court CR. MISC. No.77982 of 2024(2) dt.26-11-2024 2/2 to the hospital. It has further been alleged that the occurrence took place due to dispute between the petitioner and his cousins.

4. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the present case due to village politics. The allegation against the petitioner is general and omnibus in nature. He next submits that specific overt act has not been alleged against the petitioner. The petitioner has got no criminal antecedent.

5. Having regard to the submissions made on behalf of the parties and taking into consideration the fact that the petitioner is named in the First Information Report and allegation of firing upon the informant' brother is against the petitioner and other accused persons, I am not inclined to grant the petitioner privilege of anticipatory bail.
