JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-10-2018 Heard the parties. The petitioner seeks regular bail in connection with Forbesganj P.S.Case No. 773 of 2017, registered for the offence under Sections 394 of the Indian Penal Code.

Earlier prayer for bail of the petitioner was rejected vide order dated 08.02.2018 passed in Cr. Misc. No. 7737 of 2018 by a Co-ordinate Bench of this court.

Allegation as per F.I.R. against the petitioner is that the petitioner along with other miscreants is of committing robbery in the shop of the informant and took away Rs. 90,000/- from the cash box of the shop and another miscreants took away Rs. 50,000/- to 51,000/- from the cash box. It is further alleged that the petitioner is accused in five other cases also.

No.56964 of 2018 (3) dt.08-10-2018 2/2 Submission of the learned counsel for the petitioner is that the has falsely been implicated in this case and he has been remanded only on the basis of suspicion and the petitioner has not been put on Test Identification period and the petitioner is in custody since 10.10.2017.

Heard learned A.P.P., who opposed the prayer for bail. Having heard both sides and in view of the allegation against the petitioner, I am not inclined to grant bail to the petitioner. However, as the petitioner is in custody since 10.10.2017, the trial Court is directed to expedite the trial and try to conclude the same as soon as possible.

With the aforesaid observation, this application is dismissed.
