JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-12-2018 The petitioners seek bail in connection with G.B.Nagar P.S.Case No. 382 of 2017 registered under Sections 272, 273 and 308 of the Indian penal Code and Sections 30, 34, 36, 38 and 41 of the Bihar Prohibition and Excise Act, 2016. Allegation of recovery of 20 litres of Mahua wine from an orchard of one Tuntun Singh and petitioners are named in the FIR. Apart from that, it appears that petitioners are accused in four other cases of similar nature. Submission of learned counsel for the petitioners is that nothing has been recovered from their possession rather the same was recovered from an Orchard as such they have been falsely implicated in this case and in all other cases, they have
Patna High Court Cr.Misc. No.65393 of 2018(3) dt.12-12-2018 2/2 been made accused at the instance of the Chaukidar, who is inimical terms with the petitioners and they are in custody since 07.08.2018.

Having heard both sides and in the facts and circumstances, I am not inclined to grant bail to the petitioners at this stage, as such prayer of bail of the petitioners is rejected. However, learned Special Judge is directed to expedite the trial and conclude the same within a period of four months. If it is not concluded within the stipulated period, petitioners will have liberty to renew their prayer of bail. Accordingly, this application stands dismissed. (Vinod Kumar Sinha, J) sujit/- U T
