Petitioner seeks bail in Govindganj (Malahi) P.S. Case No. 235/2012, registered for the offences punishable under Section 302 and 34 of the Indian Penal Code, section 27 of the Arms Act and section 3/4 of the Explosive Substance Act. Allegation is that while informant's brother was going to attend natural call, petitioner and other co-accused exploded bomb upon the brother of informant. On hearing sound of explosion, people assembled there. Thereafter all the accused persons started firing and fled away.
It has been submitted that petitioner has falsely been implicated in this case due enmity. There is land dispute between
Patna High Court Cr.Misc. No.56488 of 2018 (3) dt.02-11-2018 the parties. No incriminating material has been found against him. Petitioner has been remanded in this case on 28.08.2017. Considering the facts aforesaid and nature of allegation, I am not inclined to enlarge the petitioner on bail at this stage. Accordingly, the same is rejected.
Petitioner may renew his prayer for bail after completing one year in custody.
