JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 13-12-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner seeks pre-arrest bail in connection with Shakurabad P. S. Case No. 36 of 2016 registered under Sections 420, 409 and 120-B of the Indian Penal Code.

It is submitted by the learned counsel for the petitioner that from perusal of the FIR itself, it would be manifest that the ingredients of the offences alleged would not be attracted against the petitioner. He submitted that co-accused Girja Paswan, Yogenera Paswan, Ran Vijay Singh and Nand Kishore Singh having more or less similar allegation to that of the petitioner have already been granted pre-arrest bail by

Patna High Court Cr.Misc. No.58890 of 2017 (2) dt.13-12-2017 2/2 different benches of this Court in Cr. Misc. No. 35196 of 2016, Cr. Misc. No. 37807 of 2017, Cr. Misc. No. 46342 of 2017 and Cr. Misc. No. 44334 of 2017 respectively.

Learned Additional Public Prosecutor for the State has opposed the prayer for grant of pre-arrest bail to the petitioner.

Regard being had to the facts and circumstances of the case, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Judge-1, Jehanabad in Shakurabad P. S. Case No. 36 of 2016, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure, in the event of arrest or surrender before the court below within six weeks from today.
