2. The petitioner seeks bail in a case registered for the offences punishable under Sections 8, 20(b)(ii)B of the N.D.P.S. Act.
3. The case of the prosecution, in short, is that from the trolley bag of the petitioner, altogether 8.334 Kgs. of Ganja like substance was recovered.
4. Learned counsel for the petitioner has submitted that the recovery has not been made from the conscious possession of the petitioner. It has also been submitted that the quantity of the contraband, which has been recovered allegedly from the trolley bag of this petitioner, is though more than the
Patna High Court CR. MISC. No.71907 of 2025(2) dt.14-10-2025 2/2 small quantity but is less than the commercial quantity. The petitioner is in custody since 08.04.2025. The petitioner is having antecedent of one case of similar nature.
5. Learned APP for the State vehemently opposed the bail application.
6. Considering the above facts and circumstances of the case, let petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Special Judge, NDPS Act, Gaya in connection with Rail P.S. Gaya Case No.90 of 2025, subject to the condition that petitioner shall co-operate in trial. (Ashok Kumar Pandey, J) Sanjay/- U T
