JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-12-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 28.6.2017 passed in Cr.Misc.No.24711of 2017 with direction to learned trial court to expedite the trial and conclude the same as soon as possible and there is allegation against the petitioner of kidnapping of two businessmen and police raided and caught petitioner along with firearm and cartridges.

Submission of learned counsel for the petitioner is that all the accused persons have been granted bail in this case and petitioner is in custody since 27.10.2016. Heard learned APP and perused the report of learned court below, from which it appears that trial has not been concluded due to non-production of the petitioner in this case

Patna High Court Cr.Misc. No.65087 of 2018(3) dt.12-12-2018 2/2 and he is in Central Jail, Baeur in connection with other case, i.e., Hawai Adda, Patna P.S.Case No. 170 of 2016. In the facts and circumstances, I am not inclined to grant bail to the petitioner.

However, I.G., Prison, Bihar, Jail Superintendent, Central Jail, Bauer and Jail Superintendent Lakhisarai are directed to take steps for production of the petitioner in court, so that trial may be concluded at the earliest.

With the above observation, this application is dismissed.

Let this order be communicated to the I.G., Prison, Bihar, Jail Superintendent, Central Jail, Bauer and Jail Superintendent, Lakhisarai forthwith.
