JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-12-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 10.7.2017 passed in Cr.Misc.No. 24252 of 2017 with direction to learned trial court to expedite the trial and conclude it within a period of six months and further six months time was allowed to learned trial court to conclude the trial vide order dated 21.3.2018 in Cr.Misc.No.6978 of 2018.
Submission of learned counsel for the petitioner is that till date trial has not been concluded and petitioner is in custody since 4.4.2016.
Heard learned APP and perused the report of the court below from which it appears that out of 13 charge-sheeted witnesses 12 have been examined and only I.O. has to be
Patna High Court Cr.Misc. No.69061 of 2018(3) dt.12-12-2018 2/2 examined for which summons has been issued.
In such view of the matter, I am not inclined to grant bail to the petitioner.
However, Superintendent of Police, Katihar is directed to produce the I.O. on the next date fixed in court so that the trial may be concluded as expeditiously as possible. With the above observation, this application is dismissed.
Let this order be communicated to the Superintendent of Police, Katihar forthwith.
