2. The petitioner seeks bail in connection with Rupaspur P.S. Case No. 627 of 2022 registered for the offence punishable under Sections 302/34 of the Indian Penal Code.

3. This is the second attempt for bail of the petitioner as earlier such prayer was rejected by order dated 25.05.2023 in Cr. Misc. No. 29013 of 2023.

4. Learned counsel for the petitioner submits that the petitioner is in jail since 14.10.2022. Learned counsel further submits that similarly situated co-accused persons in this case have been granted regular bail by Co-ordinate Benches of this Court vide orders dated 30.05.2023, 26.06.2023 and 21.07.2023

5. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.

6. Considering the grant of bail to co-accused and also considering the fact that a thief was caught who was assaulted by a large number of person and thereafter he died because of assault by the members of the mob, I am inclined to grant bail to the petitioner.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM 1st Danapur at Patna in connection with Rupaspur P.S.
