JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-11-2018 The petitioner seeks regular bail in connection with Mahua P.S. Case No. 136/2018, registered for offences punishable under Sections 304(B), 120(B) and 34 of the Indian Penal Code.

Allegation against the petitioner is of dowry death and he happens to be the husband of deceased.

Submission of learned counsel for the petitioner is that deceased was suffering from illness. She was taken to the government hospital for treatment and during course of treatment she died. The matter was informed to the informant and the informant also participated in the cremation and thereafter, this false case has been lodged after four days of the occurrence. He is in custody since 22.06.2018 Heard learned A.P.P. also. He opposed the prayer for

Patna High Court Cr.Misc. No.63586 of 2018(3) dt.20-11-2018 2/2 bail submitting that there is no document which shows that she was under treatment or she was examined by any doctor. The dead-body has also been disposed of in hurried manner. Having heard both sides, considering the facts and circumstances of the case, I am not inclined to grant bail to the petitioner above-named.

However, trial court is directed to hold trial on regular basis and conclude the same expeditiously.
