Petitioners apprehend arrest in connection with Janta Bazar P.S. Case No. 1 of 2019 registered for the offence punishable under sections 304B/34 of the Indian Penal Code.

Learned counsel appearing for the petitioners submits that petitioners have not committed any offence as alleged in the first information report and they have been falsely implicated in this case merely because they are the mother-in-law and father-in-law of the deceased. The husband of the deceased is in custody. Petitioners have no criminal antecedent.

Learned Addl. P.P. appearing for the State

Patna High Court CR. MISC. No.72715 of 2019(13) dt.28-02-2022 2/2 opposes the prayer for bail and submits that there is specific allegation against the petitioner no. 1 of pouring k. oil and litting fire, and as such, she does not deserve to be granted the privilege of anticipatory bail.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner no. 2, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing personal bond to the satisfaction of Additional Chief Judicial Magistrate, V, Saran at Chapra in connection with Janta Bazar P.S. Case No. 01 of 2019 subject to the conditions laid down under section 438(2) Cr.P.C.

So far as petitioner no. 1 is concerned, considering the nature of allegations levelled and the submissions advanced on behalf of the parties, this Court is not inclined to grant the privilege of anticipatory bail. Her prayer for bail is, accordingly, rejected.
