The petitioner has prayed for bail in a case registered for the offence punishable under sections 406, 420, 506, 323, 504/34 of the Indian Penal Code.
As per allegation in the FIR, wife of the petitioner runs a Self Help Group (NGO) of six groups. From all the groups she has collected Rs. 5,40,000/- for depositing in the Bank Account but out of total amount, she has misappropriated an amount of Rs. 108000/- (Rs. One lac and eighty thousand). It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. Petitioner has never received any amount from any people rather his name has been dragged in the present case because of his wife runs a
Patna High Court CR. MISC. No. 72294 of 2022(2) dt.21-03-2023 2/2 Self Help Group. No documentary evidence is brought on record to show the complicity of the petitioner. Petitioner is languishing in judicial custody since 18.10.2022. The application for bail is opposed by learned APP for the State.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned CJM, Jamui in connection with Khaira P.S.
