JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-12-2018 Petitioner prays for bail in connection with Jainagar P.S.Case No. 385 of 2018, G.R.No. 1400 of 2018, registered for the offences punishable under Sections 302, 201 and 120B/34 of the Indian Penal Code.
Allegation against the petitioner is that he along with deceased had gone out and later on dead body of deceased was found and petitioner is named in the FIR.
Submission of learned counsel for the petitioner is that there is enmity between the parties from before and except self-confession of the petitioner there is nothing against him, there is no recovery from his possession and he is in custody for more than five months.

Having heard both sides and in the facts and
Patna High Court Cr.Misc. No.69431 of 2018(3) dt.18-12-2018 2/2 circumstances, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Madhubani/Incharge Successor Court, in connection with Jainagar P.S.Case No. 385 of 2018, G.R. No. 1400 of 2018, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
