The petitioner seeks anticipatory bail in connection with Pakaridyal PS case no. 151 of 2016 registered for the offences punishable under Sections 302/34/120(B) of the Indian Penal Code and section 27 of the Arms Act.

The allegation against the petitioner is regarding calling the son of the informant to the office of D.T.O. for preparation of motorcycle paper, whereafter the said son of the informant went missing and subsequently his dead body was recovered. The learned counsel for the petitioner submits that there is no material on record to suggest the complicity of the petitioner in the alleged crime.

Patna High Court Cr.Misc. No.59438 of 2017 (3) dt.12-01-2018 2/2 Per contra, the learned A.P.P. for the State has submitted that in paragraph-28 of the case diary, the eye witness has specifically seen and named the petitioner as one of the person, who was assaulting the deceased.

In view of sufficiency of the material in the case diary, I do not find it a fit and proper case to grant anticipatory bail to the petitioner.

The petition is dismissed.
