====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 09-01-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Lodipur P.S. Case No. 140 of 2018 instituted for the offence under Sections 364A and 120B/34 of the Indian Penal Code.

In the written report it is alleged that petitioner took five years old son of the informant on the occasion of independence day (15th August) and he did not return. The informant enquired about his son from petitioner but he showed his ignorance. It is further alleged that informant received ransom call in his Mobile for return of his son. Counsel for the petitioner submits that boy has not been recovered from possession of the petitioner. During investigation it has come that victim boy has been recovered by

Patna High Court Cr.Misc. No.73405 of 2018(3) dt.09-01-2019 2/2 the police from the house of Shambhu Mandal. The police has arrested the petitioner from his house and recorded his confessional statement.

Petitioner is in custody since 19.8.2018 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur, in connection with Lodipur P.S.
