This application for anticipatory bail arises out of Laheriasarai P.S. Case No. 155/2015 for the offence under Sections 406, 409, 420, 120(B) of the Indian Penal Code. Considering the fact that this Court has refused to grant anticipatory bail to other co-accused persons, namely, Gaurav Kumar Choudhary vide order dated 19.05.2016 passed in Cr. Misc. No. 58075 of 2015, Murari Prasad Chaudhary vide orders dated 19.07.2016 passed in Cr. Misc. No. 3808 of 2016 and dated 06.09.2017 passed in Cr. Misc. No.22965 of 2017, I am not inclined to entertain this application for grant of anticipatory bail.

Learned Senior Counsel appearing on behalf of the

Patna High Court Cr.Misc. No.75800 of 2018(3) dt.09-01-2019 2/2 petitioner has submitted that the petitioner is neither named in the First Information Report nor there is any direct material for his implication in the case.

Be that as it may, following the decision of this Court, while rejecting anticipatory bail applications made on behalf of similarly circumstanced other co-accused persons, this application is dismissed.

The petitioner is directed to surrender before the Court below within a period of four weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered by the learned Court below on its own merit without being prejudiced by rejection of present application for grant of anticipatory bail.
