JUSTICE ASHUTOSH KUMAR ORAL ORDER 04-12-2019 The petitioner, who is in custody since 10.08.2019 and has clean antecedents seeks bail in connection with Gopalpur P.S. Case No. 171 of 2019 which has been instituted for the offences under Sections 272, 273, 420 of the Indian Penal Code and Section 30(a), 35, 38 of the Bihar Prohibition & Excise Act, 2016.

It appears that there has been a recovery of approximately fifty litres of liquor from a motorcycle. The implication of the petitioner in the present case is because of mistaken identification.

Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.68142 of 2019(2) dt.04-12-2019 2/2 he is not connected with the vehicle in any manner whatsoever.

Considering the period of custody of the petitioner and the nature of accusation, he is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cum-Special Judge(Excise), Gopalganj in connection with Gopalpur P.S.
