ANJANA MISHRA ORAL ORDER 14-12-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner is in custody since 24.09.2017 in connection with a case registered for the offences punishable under Sections 414/34 of the Indian Penal Code. Learned counsel for the petitioner submits that the motorcycle in question was taken by him for obtaining medicines from a shop when it was intercepted and arrested by the police. It is further submitted that actually he was unaware that Nazir Mian had been in possession of such stolen property. Moreover, there is nothing on record to show that the motorcycle in question, alleged to have been recovered from the present petitioner was, in fact, a stolen property for which a First Information Report had been lodged.
Patna High Court Cr.Misc. No.58798 of 2017 (2) dt.14-12-2017 2/2 Considering the aforementioned facts and circumstances and that the petitioner has got no criminal antecedent, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Gopalganj, in connection with Gopalpur P.S. Case No. 122/2017.
