JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-06-2018 Petitioners apprehend their arrest in connection with Pothia P.S. Case No. 122 of 2017 registered for the offences punishable under Sections 363, 366A/34 of the Indian Penal Code. Allegation against the petitioners is that they conspired with the main accused Saddam@Buta in kidnapping the minor daughter of the informant.

Submission of learned counsel for the petitioners is that accused Saddam@Buta married with the daughter of the informant and they have filed a petition before the High Court of Panjab and Haryana for their protection, on which the notice had issued to the Senior Superintendent of Police, Gurdaspur and they are ready to co-operate with police if they have been granted privilege of anticipatory bail.

Having heard both sides and in the facts and circumstances, let the petitioners, named above, surrender within a period of six weeks from the receipt of this order and on their so surrendering they will be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-III, Kishanganj, in connection with Pothiya P.S. Case No. 122 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further conditions are that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and further condition is that the petitioners have to co-operate in the investigation and appear before the Investigating Officer as and when required, otherwise their bail bonds shall be cancelled.
