The petitioner in the present case is seeking regular bail in connection with Rudrapur P.S. Case No.48 of 2019 registered for the offence punishable under Section 392 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Learned counsel submits that the petitioner is not named in the FIR and no incriminating article has been recovered from the possession of this petitioner.

Learned APP has opposed the prayer for bail.

Considering the facts and circumstances of the case wherein it is the submission of learned counsel for the petitioner

No.72668 of 2019(2) dt.14-01-2020 2/3 that no incriminating article has been recovered from the possession of the petitioner, till date he has not been identified as no T.I.P has been conducted and that the petitioner is in custody since 12.06.2019 whereas the co-accused Ranjeet Choudhary has been granted privilege of regular bail by a learned coordinate Bench of this Court in Cr.Misc.No.57634 of 2019 as also that though two cases are pending against the petitioner in which he is on bail, but those cases are not of similar nature, let the petitioner above named be released on bail on furnishing bail bond of Rs. 15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-II, Jhanjharpur, Madhubani in connection with Rudrapur P.S. Case No.

48 of 2019, subject to the condition as laid down under Section 437 (3) Cr.P.C.
