The petitioners seek anticipatory bail in connection with Korha P.S.Case No. 427 of 2017, registered for offences punishable under Sections 366/34 of the Indian Penal Code. Allegation against the petitioners is of kidnapping the son of the informant and still he is traceless. Submission of the learned counsel for the petitioners is that the petitioners have not committed any type of offence rather they have falsely been implicated in this case only on the basis of suspicion. It is alleged that there is previous land dispute
Patna High Court Cr.Misc. No.21607 of 2018 (3) dt.20-06-2018 2/2 between the parties.
Learned A.P.P. as well as learned counsel for the informant oppose the prayer for bail on the ground that the victim is still traceless.
Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of six weeks from the date of the order, be released on anticipatory bail on furnishing bail bonds of Rs. 25,000/- ( Twenty five thousand) with two sureties of the like amount each in connection with Korha P.S. Case No. 427 of 2017 to the satisfaction of learned Chief Judicial Magistrate, Katihar, subject to the conditions laid down under Section 438 ( 2) Cr.P.C. with other that bailors should be local having sufficient immovable property within the jurisdiction of the Court concerned and petitioners shall cooperate in the investigation and shall be present before police as and when required, otherwise prosecution is at liberty to move for cancellation of their bail bonds.
