JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-11-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act, 2016.

The alleged recovery is said to have made from an orchard and according to prosecution case itself, the seized liquor belonged to F.I.R. named accused Surrender Kumar and so far as petitioner is concerned, it is said that when police party raided the above stated orchard, the petitioner was seen fleeing from there. Moreover, petitioner does not have any criminal antecedent.

Considering the aforesaid facts and circumstances as

No.67071 of 2019(2) dt.04-11-2019 2/2 well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-IVCum-Special Judge, Excise, Bhojpur at Ara in connection with Shahpur P. S. Case No. 117 of 2019 read with Excise Case No. 1003 of 2019.
