Earlier bail applications of the petitioner were rejected vide Cr. Misc. No. 30905 of 2019 under order dated 20.09.2019, Cr. Misc. No. 38495 of 2020 under order dated 24.03.2021 and Cr. Misc. No. 59043 of 2021 under order dated 19.01.2022, annexed as Annexures-1, 1/A and 1/B to the present application taking into account that the petitioner was one of the assailants.

This is fourth attempt on behalf of the petitioner

Patna High Court CR. MISC. No.73469 of 2022(3) dt.22-03-2023 2/3 for grant of bail.

A report was called for from the court below regarding the present stage of the case. It has been reported that out of six charge-sheeted witnesses four chargewitnesses have already been examined and only two official witnesses are yet to be examined.

Considering the nature of accusation and the stage of the case, I am not inclined to grant bail to the petitioner. The same is rejected in Sessions Trial No. 374 of 2019, arising out of Piro (Hasan Bazar) P.S. Case No. 240 of 2018, pending in the court of learned Additional District and Sessions Judge-IX, Bhojpur at Ara.

Learned court below is directed to take all necessary steps to conclude the trial preferably within a period of four months from the date of receipt/production of a copy of this order.

The District Magistrate and the Superintendent of Police, Bhojpur at Ara are directed to ensure that the remaining two official prosecution witnesses are produced on the fixed date in the court below so that the trial could be concluded within the stipulated period.
