JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-06-2018 Petitioner apprehends his arrest in connection with Nawada Mahila P.S.Case No. 58 of 2016 registered for the offences punishable under Sections 354A and B of the Indian Penal Code and Sections 8/12 of POCSO Act.
Allegation against the petitioner is of touching minor girls of the school and petitioner happens to be a teacher of the said school.
Submission of learned counsel for the petitioner is that the whole allegation is vague and no specific date has been mentioned and independent witnesses have also not supported the case during investigation.
Heard learned APP also, who has opposed the prayer for anticipatory bail on the ground that statements of other girls have
Patna High Court Cr.Misc. No.12829 of 2018 (3) dt.19-06-2018 2/2 also been recorded and they have supported the prosecution case and made allegation against the petitioner.
Having heard both sides and in the facts and circumstances, I am not inclined to grant privilege of anticipatory bail to the petitioner. Petitioner to surrender and make prayer for regular bail, which shall be considered on its own merit, without being prejudiced by this order.
