The petitioner seeks regular bail in connection with Aurangabad (Muffasil) P.S. Case No.113 of 2017 instituted for the offences under Sections 30(a) and 38 of the Bihar Prohibition and Excise Act, 2016.

The allegation is regarding recovery of 280 litres of illicit country made liquor from a Maruti Suzuki Van in which the petitioner is said to be sitting as a co-passenger. The learned counsel for the petitioner submits that the petitioner is innocent and is neither the owner nor the driver of the said vehicle and had merely taken lift in the said Car. It is submitted

Patna High Court Cr.Misc. No.59628 of 2017 (2) dt.22-12-2017 2/2 that the petitioner is languishing in custody since 06.07.2017. Considering the nature of accusation and the period of custody already undergone, I direct the petitioner named above to be released on regular bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VII-cumSpecial Judge (Excise), Aurangabad in connection with Aurangabad (Muffasil) P.S.
