JUSTICE SANJAY PRIYA ORAL ORDER 08-02-2018 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in Awtarnagar P.S. Case No. 83 of 2017 instituted for the offence under Sections 304(B),201/34 of the IPC.

The petitioner is the husband of the deceased. There is specific allegation in the written report against the petitioner that after marriage the petitioner and his family members used to torture the deceased for demand of dowry.

It is alleged that in the night of 07.06.2017 this petitioner with other accused persons killed the grand-daughter of the informant and got her dead body disappeared. The case diary has been received, wherein, the witnesses have supported the case. Learned counsel for the petitioner has submitted that

It is apparent from case diary that the dead body was not found. There is no post-mortem report available in the case diary.

There is specific allegation of overt act against the petitioner. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.

Accordingly, this anticipatory bail petition stands rejected.

The petitioner is directed to surrender in the court below within six weeks from today and seek regular bail which will be considered and disposed off by the court below in accordance with law without being prejudiced by this order and if possible, on the same day.
