The petitioner seeks bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code. The prosecution case is that the informant Pramod Kumar has filed this case against the petitioner and two others alleging that in the night of 08/09.06.2019 around 1.15 A.M. when he was returning to his house from the house of his relative his motorcycle. The petitioner pointed country made pistol and the co-accused snatched Rs.10,300/- and his mobile phone and the petitioner snatched his motorcycle.
Learned counsel for the petitioner submits that there is no recovery from the conscious possession of the petitioner, rather, stolen motorcycle has been recovered from the house of Pintu Gope. Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-XIV, Saran at Chapra, in connection with Akilpur P.S. Case No. 30 of 2019, subject to the following conditions:
(1) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.
(2) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by Court and his absence on two consecutive dates without sufficient reasons, his bail bond shall be cancelled by the court below.
(3) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner. (Anjani Kumar Sharan, J) amitkumar/- U T
