Petitioner apprehends his arrest in connection with Hawai Adda P.S.Case No. 42 of 2014 registered for the offences punishable under Section 420 of the Indian Penal Code. Allegation against the petitioner, who happens to be Secretary of Bihar State Ex-serviceman Co-operative Development Corporation Ltd., is that he has issued an advertisement for the post of Computer Awareness Programmer on the logo of Bihar State Co-operative Development Corporation. Submission of learned counsel for the petitioner is that he has done in the capacity of Secretary on the instruction of Chairman of the so-called Ex-serviceman Co-operative Development Corporation and he is an employee of the Corporation.

Patna High Court Cr.Misc. No.14936 of 2018 (4) dt.21-08-2018 2/2 Heard learned APP also, who has opposed the prayer for anticipatory bail.

Having heard both sides and in the facts and circumstances, I am not inclined to grant privilege of anticipatory bail to the petitioner. However, if the petitioner surrenders and makes prayer for regular bail, the same shall be considered on its own merit and to be disposed of, if possible, on the same day.
