JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-10-2019 Petitioner seeks bail in anticipation of his arrest in connection with Jandaha P.S. Case No. 59 of 2019 registered for the offences punishable under Sections 30(a) and 45 of Bihar Prohibition and Excise Act.

There is recovery of 15 litres of liquor from the possession of the petitioner.

Submission of learned counsel for the petitioner is that he has falsely been implicated, nothing has been recovered from his conscious possession and he has no criminal antecedent.

Heard learned APP, who has opposed the prayer for anticipatory bail on the ground that recovery is made from the petitioner.

In view of above facts and circumstances, this

No.64875 of 2019(2) dt.18-10-2019 2/2 application is disposed of with direction to the petitioner to surrender and pray for regular bail, which shall be considered on its own merit, without being prejudiced by this order and, if possible, to be disposed of on the same day.
