JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-06-2018 Petitioners apprehend their arrest in connection with Laheriasarai P.S. Case No. 48 of 2017 registered for the offences punishable under Sections 341, 323, 379, 354 and 504/34 of the Indian Penal Code.

Allegation against the petitioners is that they have assaulted the informant and tried to disrobe her. Submission of learned counsel for the petitioners is that FIR itself shows that dispute relates to construction of wall and no such occurrence as alleged has taken place and informant is in habit of filing of such false cases.

Heard learned APP also, who has opposed the prayer for anticipatory bail of the petitioners on the ground that case diary

Patna High Court Cr.Misc. No.21332 of 2018 (3) dt.25-06-2018 2/2 shows that petitioners were on police bail earlier. Having heard both sides and in the facts and circumstances, let the petitioners, named above, surrender and make prayer for regular bail, which shall be considered and disposed of keeping in view the fact that petitioners were on police bail earlier, if possible, on the same day.

With the above observation, this application is disposed of.
