Petitioner apprehends arrest in Amarpur (Fullidumar) PS Case No. 512 of 2017, registered under Sections 341, 323, 308, 448, 504 and 506/34 of the IPC.
The allegation in brief is that the petitioner gave an axe blow over head of the informant.
Learned Counsel for the petitioner submits that both sides are neighbours, corresponding injury is simple in nature and the petitioner has clean antecedent. Both sides are neighbours, sole injury is simple in nature caused by hard blunt substance and not by any sharp cutting weapon as alleged.
Whereas learned Counsel for the State submits that though the injury is simple in nature but is on the mid of the head of the informant.
Having considered the said facts and circumstances, the petitioner Dilip Yadav is directed to be released on anticipatory bail in the event of his arrest or surrender within a period of four weeks from today on furnishing bail bonds of Rs. 10,000/- (Ten thousand)
Patna High Court Cr.Misc. No.25975 of 2018 (4) dt.24-05-2018 with two sureties of the like amount each to the satisfaction of CJM Banka in connection with Amarpur (Fullidumar) PS Case No. 512 of 2017, subject to the conditions as laid down under Section 438(2) Cr.P.C.
