JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-06-2018 The petitioner is apprehending his arrest in connection with Rajpur P.S. Case No. 301 of 2017, registered for offences punishable under Sections 341, 323, 384 and 34 of the Indian Penal Code.
Allegation against the petitioner is of demand of rangdari from the informant.
It has been submitted on behalf of the petitioner that as a matter of fact petitioner has lodged a case against the informant for demand of rangdari and in retaliation, the present case has been lodged. It has also been submitted that after investigation final form has been submitted and police also recommended for action under Section 182 and 211 of the Indian Penal Code. Heard learned A.P.P. also as well as learned counsel for
Patna High Court Cr.Misc. No.24284 of 2018 (3) dt.25-06-2018 2/2 the informant. Learned counsel for the informant has submitted that the petitioner has concealed his one criminal antecedent as he is accused in Rajpur P.S. Case No. 288/01 also. Having heard both sides, considering the facts and circumstances of the case, this application is disposed of with direction to the petitioner to surrender before the court below within a period of four weeks and the court below shall verify the fact that in this case final form has been submitted and police recommended for action under Section 182 and 211 of the IPC and if it is so, the court below shall enlarge the petitioner on bail on furnishing bail bonds of Rs. 25,000/- (Rs. Twenty Five Thousand) with two sureties of the like amount each to his satisfaction, otherwise, he is free to pass any order/orders he deems fit and proper.
