The petitioner seeks regular bail in connection with Sherghati PS case no. 625 of 2017 instituted for the offences punishable under Section 30(a), 30(d) of the Bihar Prohibition and Excise Act, 2016.

The allegation is regarding recovery of 1680 kg of mahua flour from the pick-up van.

The learned counsel for the petitioner submits that the petitioner is the driver of the pick-up van and has got nothing to do with the alleged occurrence, he has clean antecedent and he is in custody since 31.10.2017.

Patna High Court Cr.Misc. No.60444 of 2017 (2) dt.21-12-2017 2/2 Considering the nature of accusation, clean antecedent and the period of custody undergone, this Court is inclined to grant bail to the petitioner. Accordingly, the petitioner are directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge Excise, Gaya in connection with Sherghati PS case no. 625 of 2017. (Mohit Kumar Shah, J) rinkee/- U T
