JUSTICE SANJAY KUMAR ORAL ORDER 19-12-2017 Heard learned counsel for the petitioner as well as learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Baheri P.S. Case No.222 of 2015 registered for the offences punishable under Sections 399 and 402 of the Indian Penal Code and Section 25(1-B), 26/35 of the Arms Act.

It is alleged that a country made pistol, two live cartridges and a mobile handset were recovered by police party from possession of petitioner while he along with others had assembled in an orchard to make preparation for committing dacoity. The petitioner is in custody since 23.10.2015. The other co-accused persons, who were apprehended, are on bail. The learned A.P.P. for the State opposed the submission.

Patna High Court Cr.Misc. No.60652 of 2017 (2) dt.19-12-2017 Considering the facts and circumstances of the case, the prayer of bail is allowed. The petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of like amount each to the satisfaction of the learned Additional Sessions Judge-IV, Darbhanga in connection with Baheri P.S. Case No.222 of 2015 (S.T. No.61 of 2016), subject to the condition that one of the bailors should be close family members of the petitioner.
