====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 20-12-2024 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in a case registered for offence under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per prosecution case, it is alleged that F.I.R. named accused persons indiscriminately fired upon informant's brother, due to which, he sustained gun shot injuries and on way to hospital died.

4. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. Name of the petitioner transpired during course of investigation. He further submits that informant claimed to be eye-witness of the occurrence and as per F.I.R., petitioner has not committed the offence, rather the named accused persons committed the offence. Petitioner is in

Patna High Court CR. MISC. No.76117 of 2024(2) dt.20-12-2024 2/2 custody since 20.07.2023. Chargesheet has been submitted.

5. Learned A.P.P. for the State vehemently opposed the bail petition.

6. Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Gopalganj in connection with Manjhagarh P.S. Case No. 195 of 2023.
