2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Section 379 of the Indian Penal Code, registered in connection with Bettiah City (Kalibagh O.P.) P.S. Case No. 816 of 2023.

3. Allegedly, the Scorpio of the informant which was parked in front of his house, was stolen away by some unknown miscreants.

4. The learned counsel for the petitioner has submitted that petitioner has been falsely implicated in this case and has committed no offence. Petitioner is not named in the FIR and the same has been lodged against unknown person. She

No.75596 of 2024(2) dt.29-11-2024 2/2 submitted that on whose confession the name of the petitioner has figured in this case, has already been granted bail vide order dated 25.09.2024 passed in Cr. Misc. No. 51245 of 2024. She further submitted that the case of the petitioner is on better footing than that of co-accused Khalilur Rahman Khan. The petitioner is in custody since 05.08.2024.

5. Learned APP for the State has opposed the prayer of bail.

6. Considering the above facts and circumstances of the case, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran, Bettiah, in connection with Bettiah City (Kalibagh O.P.) P.S. Case No. 816 of 2023, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the Court.
